Welcome to PDFator. By accessing or using our website and services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Agreement to Terms

By accessing and using PDFator ("Service", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our services.

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. Service Description

PDFator provides online PDF manipulation tools including but not limited to:

  • PDF conversion (to and from various formats including Word, Excel, PowerPoint, JPG)
  • PDF merging, splitting, and reorganization
  • PDF compression and optimization
  • PDF security features (password protection, unlocking)
  • AI-powered features (summarization, translation)
  • Other PDF manipulation tools as made available on our platform

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

3. User Accounts

3.1 Account Creation

While many features are available without registration, some premium features require you to create an account. When creating an account, you must:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Termination

We reserve the right to suspend or terminate your account and refuse any current or future use of the Service for any reason, including but not limited to violation of these Terms, fraudulent activity, or abusive behavior. You may also delete your account at any time by contacting us at admin@pdfator.com.

4. Acceptable Use Policy

You agree to use PDFator only for lawful purposes and in accordance with these Terms. You agree NOT to:

Prohibited Content

Upload, process, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, hateful, or racially or ethnically objectionable.

Copyright Infringement

Upload or process files that infringe upon the intellectual property rights of others, including copyrights, trademarks, patents, or trade secrets.

Malicious Activities

Transmit viruses, malware, or any other malicious code, or attempt to gain unauthorized access to our systems, networks, or data.

Service Abuse

Use automated systems or software to extract data from our website (screen scraping), attempt to overload our servers, or use our services in any way that could damage, disable, or impair our infrastructure.

Commercial Misuse

Resell, redistribute, or create derivative works from our services without explicit written permission, or attempt to reverse engineer our software or algorithms.

Impersonation

Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.

Violation of this Acceptable Use Policy may result in immediate termination of your access to the Service and potential legal action.

5. Intellectual Property Rights

5.1 Our Content

The Service and its original content, features, and functionality are and will remain the exclusive property of PDFator. The Service is protected by copyright, trademark, and other laws. Our trademarks, logos, and service marks may not be used without our prior written consent.

5.2 Your Content

You retain all rights to the files you upload to PDFator. By uploading files, you grant us a temporary, non-exclusive license to process, modify, and convert your files solely for the purpose of providing the requested service. This license terminates when your files are deleted from our servers (which happens automatically after processing).

5.3 Copyright Infringement Claims

We respect intellectual property rights. If you believe that any content on our platform infringes your copyright, please contact us at admin@pdfator.com with:

  • A description of the copyrighted work that you claim has been infringed
  • A description of where the allegedly infringing material is located
  • Your contact information
  • A statement that you have a good faith belief that the disputed use is not authorized
  • A statement that the information in your notice is accurate

6. Payment Terms and Subscriptions

6.1 Premium Services

Some features of PDFator require a paid subscription. By subscribing to a premium plan, you agree to pay the fees indicated for that plan. All fees are in USD unless otherwise stated and are non-refundable except as required by law or as expressly stated in these Terms.

6.2 Billing and Renewals

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for recurring payments. We may change subscription fees with 30 days' notice.

6.3 Cancellation and Refunds

You may cancel your subscription at any time, and it will remain active until the end of the current billing period. We offer a 14-day money-back guarantee for first-time subscribers. To request a refund, contact us at admin@pdfator.com within 14 days of your initial purchase. Refunds are processed to the original payment method within 5-10 business days.

6.4 Free Trial

We may offer free trial periods for premium features. Free trials automatically convert to paid subscriptions unless cancelled before the trial period ends. No charges are made during the trial period.

7. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the service will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the quality, accuracy, or reliability of results obtained from the service
  • Warranties that errors in the software will be corrected

We do not guarantee that the service will meet your specific requirements or that any files processed will maintain perfect quality or formatting.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PDFATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted through the service by any third party
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the service
  • Any defamatory, offensive, or illegal conduct of any third party

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO PDFATOR IN THE LAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless PDFator, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms of Service
  • Your use of the Service
  • Your violation of any rights of another person or entity
  • Your violation of any applicable laws or regulations
  • Any content you upload, submit, or process through the Service

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and protection of your personal information and uploaded files.

  • We use encryption to protect your data during transmission and processing

11. Third-Party Links and Services

Our Service may contain links to third-party websites or services that are not owned or controlled by PDFator. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which PDFator operates, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be resolved through binding arbitration in accordance with the rules of an appropriate arbitration association, except where prohibited by law.

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be replaced with a valid, enforceable provision that most closely matches the intent of the original provision.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and PDFator concerning your use of the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and PDFator.

15. Waiver

No waiver by PDFator of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by PDFator to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
